อย่างไรก็ตาม เอไอเอสเห็นว่าเป็นแนวทางที่ไม่สามารถเป็นไปได้จริงทั้งในแง่กฎหมาย เนื่องจากยังเป็นปัญหาในข้อกฎหมายที่ กสทช.ต้องพิจารณาว่าจะเข้าข่ายเป็นการให้ผู้อื่นมาร่วมใช้คลื่นความถี่หรือไม่ อีกทั้งในทางปฏิบัติไม่สามารถดำเนินการได้เวลาอันสั้น
