ทั้งนี้ แม้ว่าทั้ง STO และ ICO จะเป็นการนำเทคโนโลยีมาใช้ในการระดมทุนเหมือนกัน แต่ในการกำกับดูแลจะอยู่ภายใต้กฎหมายคนละฉบับ โดย STO อยู่ภายใต้ พ.ร.บ.หลักทรัพย์และตลาดหลักทรัพย์ พ.ศ. 2535 ขณะที่ ICO อยู่ภายใต้ พ.ร.ก.การประกอบธุรกิจสินทรัพย์ดิจิทัล พ.ศ. 2561 และเพื่อไม่ให้เกิดความซ้ำซ้อนในการกำกับดูแล ใน พ.ร.ก.การประกอบธุรกิจสินทรัพย์ดิจิทัลฯ จึงกำหนดไว้ว่าหากเป็นหลักทรัพย์ตาม พ.ร.บ. หลักทรัพย์ฯ แล้ว จะไม่เป็นสินทรัพย์ดิจิทัลตาม พ.ร.ก. การประกอบธุรกิจสินทรัพย์ดิจิทัลฯ

บริษัทมีทุนจดทะเบียน 120 ล้านบาท เป็นทุนจดทะเบียนเรียกชำระแล้ว 90 ล้านบาท แบ่งเป็นหุ้นสามัญ 180 ล้านหุ้น มูลค่าที่ตราไว้หุ้นละ 0.50 บาท หลังเสนอขายหุ้นเพิ่มทุนในครั้งนี้ บริษัทฯจะมีทุนจดทะเบียนชำระแล้วเต็ม 120 ล้านบาท แบ่งเป็นหุ้นสามัญ 240 ล้านหุ้น มูลค่าที่ตราไว้หุ้นละ 0.50 บาท ผู้ถือหุ้นรายใหญ่ของบริษัท ณ วันที่ 31 มี.ค.59 คือ กลุ่มครอบครัวนางสาวอรสา วิมลเฉลา 147,100,000 หุ้น คิดเป็น 81.72% หลังเสนอขายหุ้นเพิ่มทุนในครั้งนี้แล้วจะลดสัดส่วนการถือหุ้นลงเหลือ 61.29%
