ทั้งนี้ เนื่องจากศาลเห็นว่า มติบอร์ด ขสมก. ในการประชุมวันที่ 18 ธ.ค.60 และการประชุมวันที่ 20 ธ.ค.60 น่าจะไม่ชอบด้วยกฎหมาย เพราะปรากฏข้อเท็จจริงจากพยานว่า ในการประชุมทั้ง 2 ครั้งดังกล่าว ไม่มีการลงมติอนุมัติให้ ขสมก. เข้าทำสัญญา และไม่มีการรับรองรายงานการประชุมดังกล่าว จึงสั่งมิให้ ขสมก. และบอร์ด ขสมก. นำมติดังกล่าวไปดำเนินการใดที่มีผลผูกพันกับขสมก.และบอร์ดขสมก.เป็นการชั่วคราวจนกว่าศาลจะมีคำพิพากษาหรือคำสั่งเป็นอย่างอื่น
